By using the Service, you represent and warrant that:
•
You are at least 13 years of age.
•
If you are under 18 years of age (or the age of legal majority where you live), you have the permission of a parent or legal guardian to use the Service, and that parent or guardian agrees to be bound by these Terms on your behalf.
•
You are legally permitted to use the Service under applicable laws in your jurisdiction.
2. Accounts
To access certain features, you may be required to create an account.
You are responsible for:
•
Maintaining the confidentiality of your account credentials.
•
All activity that occurs under your account.
We reserve the right to suspend or terminate accounts at any time if we believe these Terms have been violated or if required by law.
3. User Content
The Service may allow you to send, upload, create, or share content, including messages, text, images, or other materials (“User Content”).
•
Ownership: You retain ownership of your User Content.
•
License: By submitting User Content through the Service, you grant us a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, transmit, modify, run, and display such content solely for the purpose of operating, providing, and improving the Service.
•
Responsibility: You are solely responsible for your User Content and any consequences of sharing it.
4. AI-Generated Content and Interactive UIs
The Service utilizes artificial intelligence models to generate text, code, interactive user interfaces (such as charts, maps, and interactive projects), and other materials (“Generated Content”).
By using these AI features, you acknowledge and agree that:
•
Accuracy: AI systems are probabilistic and may produce inaccurate, incorrect, offensive, or misleading information (“hallucinations”). Generated Content is provided for informational and creative purposes only and does not constitute professional, legal, medical, or financial advice.
•
Code & Functionality: The Service may generate interactive software elements or code. We do not warrant that such code will be secure, bug-free, or function as intended. You assume all risks associated with running, executing, or interacting with AI-generated interfaces.
•
Ownership of Output: Subject to your compliance with these Terms, you own the rights to Generated Content created by your prompts. You acknowledge, however, that AI systems may generate identical or similar output for other users, and you have no exclusive claim over such similar outputs.
5. Prohibited Conduct
You agree not to use the Service to:
•
Violate any applicable laws or regulations.
•
Harass, abuse, threaten, or harm others.
•
Share illegal, harmful, exploitative, or abusive content.
•
Malicious Use of AI: Use AI features to generate malware, viruses, phishing interfaces, deceptive web pages, or code intended to disrupt or gain unauthorized access to systems, networks, or data.
•
Security Abuse: Use the Service to scrape data, harvest credentials, track users without consent, execute unauthorized scripts, exploit vulnerabilities, or attempt to bypass sandboxing, isolation, or security controls.
•
Jailbreaking: Attempt to bypass, disable, or circumvent safety filters, content moderation systems, or usage restrictions.
•
Export Controls: Use the Service in violation of U.S. export laws or sanctions.
•
Impersonate another person or entity.
•
Interfere with or disrupt the Service or its infrastructure.
We reserve the right to investigate and take appropriate action against violations, including content removal or account termination.
6. Moderation and Enforcement
This section explains how we moderate content on the Service. The rules for what may be published or posted are in these Terms and in our Community Guidelines (at /guidelines on our websites and in the app), which are part of these Terms. We are not obligated to monitor everything on the Service.
6.1 How We Moderate
•
Review before publishing. A person reviews every Project submitted for publishing before it becomes public, and may decline to publish it.
•
Automatic checks. Comments are checked automatically before they appear, for links and for terms on a blocked list. A comment that matches is held: only its author sees it, marked “Pending review”, until it is reviewed.
•
Reports. Signed-in users can report a Project, comment or account in the app. Anyone can send a notice of illegal content (Section 6.3).
•
Automatic holds. When several established accounts report the same Project or comment, or anyone reports a child safety problem, it is held automatically until a person reviews it: a held Project is not shown on Home, in similar Projects, in search or in search engines, but its link still works; a held comment is visible only to its author. An automatic hold with no decision after 72 hours is lifted while the review continues, except a hold for child safety, which is never lifted automatically.
•
Decisions. After a review, a person may take no action; limit a Project (it is no longer shown on Home, in similar Projects, in search or in search engines, but still opens by its link), for a set time or with no end; remove a Project or a comment; remove a profile picture; ban an account from commenting, for a set time or with no end; or, for severe breaches, remove the content and ban the account from commenting and from submitting Projects. We may also suspend or terminate accounts (Section 2), and remove or restrict content where the law requires it.
•
Creators’ tools. The creator of a Project can remove comments on it, approve or remove other people’s comments the automatic checks held on it, turn its comments off, and block people.
6.2 Statements of Reasons
When we restrict your content or your account, we tell you in the app: what we did, where it applies and for how long, the facts we relied on, whether it followed a report or our own review, whether automated tools were involved, the rule or law it is based on, and how you can seek redress. When you report something, we confirm that we received it and tell you what we decided.
6.3 Notices of Illegal Content
To tell us about content you believe is illegal, use “I believe this is illegal” when you report it in the app, or email the address below. Include: where the content is (its link); why you believe it is illegal and under which law, and the country; your name and email address (not required for a notice about child sexual abuse material); and a statement that you believe, in good faith, that your notice is accurate and complete. Copyright notices may also be sent under Section 7. The Community Guidelines say how quickly we respond.
Notices TapCanvas Labs, Inc. Email: support@tapcanvas.com
6.4 Redress
If you disagree with a decision about your content, your account or your notice, reply to the notice by writing to the address above and tell us why; we will look at it again. You can also go to court and, if you are in the European Union, to a certified out-of-court dispute settlement body. Section 10 does not prevent you from using these routes for a moderation decision where the law gives you the right to.
6.5 Points of Contact
The address above is our single point of contact for users and for the authorities of the European Union Member States, the European Commission and the European Board for Digital Services. We communicate in English.
7. Copyright and DMCA
We respect the intellectual property rights of others and expect users to do the same.
If you believe that content on the Service infringes your copyright, you may submit a notification pursuant to the Digital Millennium Copyright Act (DMCA) by providing the following information:
1.
A description of the copyrighted work claimed to have been infringed;
2.
A description of the material claimed to be infringing and its location on the Service;
3.
Your contact information;
4.
A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law;
5.
A statement, under penalty of perjury, that the information provided is accurate and that you are the copyright owner or authorized to act on their behalf;
6.
Your physical or electronic signature.
DMCA notices should be sent to:
DMCA Agent TapCanvas Labs, Inc. Email: dmca@tradingflow.ai
We reserve the right to remove allegedly infringing content and to terminate accounts of repeat infringers.
8. Disclaimer of Warranties
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied.
We do not guarantee that:
•
The Service will be uninterrupted or error-free;
•
Content (including AI-generated content and interactive UIs) will be secure, accurate, or not lost;
•
The Service will meet your expectations or requirements.
9. Limitation of Liability
To the maximum extent permitted by law, TapCanvas Labs, Inc. shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenues, data, use, goodwill, or other intangible losses, resulting from:
(a) Your use or inability to use the Service; (b) Any conduct or content of any third party on the Service; or (c) Unauthorized access, use, or alteration of your content or transmissions.
10. Dispute Resolution and Class Action Waiver
•
Informal Resolution: You agree to first attempt to resolve any dispute by contacting us at the email provided below.
•
Arbitration: If a dispute cannot be resolved informally, it shall be resolved by binding arbitration conducted by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in the English language. Judgment on the arbitration award may be entered in any court having jurisdiction thereof.
•
Exceptions: Notwithstanding the foregoing, either party may bring individual actions in small claims court if the claims qualify.
•
Class Action Waiver: You and TapCanvas Labs, Inc. agree that claims may be brought only in an individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
11. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict-of-law principles.
Except where arbitration is required under Section 10, any legal action or proceeding arising under these Terms shall be brought exclusively in the federal or state courts located in Delaware.
12. General Provisions
•
Severability: If any provision of these Terms is held to be invalid or unenforceable, such provision will be enforced to the maximum extent permissible, and the remaining provisions of these Terms will remain in full force and effect.
•
Entire Agreement: These Terms constitute the entire agreement between you and TapCanvas Labs, Inc. regarding the Service and supersede all prior or contemporaneous oral or written communications.
•
Waiver: Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
13. Subscriptions, Credits, and In-App Purchases
The Service offers optional paid subscription plans (such as Pro and Max) and consumable credit packs. These are sold as in-app purchases through the Apple App Store or Google Play (the “App Stores”).
•
Auto-Renewal: Subscriptions are auto-renewable. Your subscription automatically renews at the then-current price unless you cancel at least 24 hours before the end of the current billing period. You can manage or cancel your subscription in your App Store or Google Play account settings.
•
Billing: Payment is charged to your App Store or Google Play account at confirmation of purchase, and the renewal amount is charged within the 24-hour period prior to the end of the current period.
•
Credits: Credit packs are one-time, consumable purchases applied to your account. Credits have no cash value, are not redeemable for cash, and, except where required by law, are non-refundable.
•
Plan Limits and Storage: Paid plans raise your storage and usage limits. If you downgrade, cancel, or your subscription lapses, your existing content is retained, but new uploads or usage may be blocked while your account is over the limits of your current plan.
•
Price Changes: We may change subscription prices and the credits or features included in a plan. Changes apply to future billing periods and, where required by law or App Store policy, only after notice and your consent.
•
Refunds: Purchases are processed by the App Stores. Refund requests are handled by, and subject to, the applicable App Store’s policies.
14. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we may notify users through the Service or by other reasonable means.
Your continued use of the Service after changes become effective constitutes acceptance of the updated Terms.
15. Contact Us
If you have questions about these Terms, please contact us at:
TapCanvas Labs, Inc. Email: support@tradingflow.ai
16. What the RemixTree Library Holds
The RemixTree Library is public to every agent that uses it. Only generic content may be sent there: no personal data, no settings or data from your Projects, and no material you do not have the rights to share. Content is checked automatically before it is stored and may be rejected; content found later to break these rules is removed.
16.1 Publishing to the RemixTree Library
When your agent publishes a component to the RemixTree Library on your behalf, you grant everyone the right to use it under the licence shown on that component, which is one of the licences the library accepts, and you confirm that you have the right to do so. This is separate from the licence in Section 17.1 for Projects you publish. Publishing cannot be undone: the component stays available to others, without your name, even if you delete your account.
17. Publishing, Projects and the Community
17.1 Publishing
When a Project you submit is published, it becomes public worldwide: anyone can find and open it on the web, without an account, and in our apps, and search engines can index it. In addition to the license in Section 3, you grant us a worldwide, non-exclusive, royalty-free license, while the Project is published, to host, reproduce, display, run and distribute it, its title and description, its previews and preview videos, and your username and profile picture with it, on TapCanvas and our other products, websites and apps; to let other people open it, use it and save a copy of it; and to let search engines index it.
You can unlist a Project (it still opens by its link but is no longer listed or indexed) or withdraw it (it can no longer be opened) at any time. Copies other people saved before stay in their Library. Cached copies of public pages may be shown for a short time after a change.
17.2 Community Guidelines
You must follow the Community Guidelines in everything you publish or post, and you accept them before your first comment or submission. They add to Section 5. In particular, child sexual abuse and exploitation (CSAE) is prohibited without exception: child sexual abuse material, sexualising minors, grooming and sextortion. We remove it, close or restrict the accounts involved, and report it to the National Center for Missing & Exploited Children (NCMEC) and, where the law requires it, to the authorities.
17.3 Ratings, Opens, Comments, Follows, Blocks and Home
•
Ratings. You can like or dislike a Project, but not your own. A Project’s likes are shown publicly; its dislikes only to its creator.
•
Opens. Opening a published Project gives you a temporary copy to use; it is kept only if you save it to your Library. Each account’s opens of a Project are counted at most once a day.
•
Fair use. Don’t inflate or manipulate ratings, opens, comments or follows, for example with bots, extra accounts or paid or traded engagement. We may leave such activity uncounted, limit how often you can rate, open, comment, follow or report, and restrict accounts involved.
•
Comments. You are responsible for your comments. You can edit or delete them; a comment may be held for review (Section 6). The creator of a Project decides whether it takes comments and can remove comments on it.
•
Follows. Following a creator shows their new Projects on your Home and may notify you about them. Only follower counts are public.
•
Blocks. Blocking someone hides their Projects and comments from you and stops them commenting on your Projects or replying to your comments.
•
Home. Home and similar Projects are ordered by our systems, and for you when you are signed in (the Privacy Policy explains how). We do not promise any Project a place, an audience or a number of opens, and we may feature Projects or stop featuring them.
